Muse Bathhouse – Terms & Conditions

1. Relocation Disclaimer

Muse Bathhouse has recently relocated to new premises. Our website is currently being updated and may display images, descriptions, facilities, or services that are no longer available at our new location.
In particular, the new premises does not have multiple spas, a swimming pool, a sauna, or outdoor showers.
All bookings are subject to the facilities available at our current location only.

2. Acceptance of Terms

By making a booking, purchasing a gift voucher, or using our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
Payment of your booking is deemed acceptance of these Terms.

3. Behaviour and Facility Use

• Please respect the Bathhouse as a calm and healing environment. Speak quietly and be mindful of other guests.

• Long hair must be tied up. Avoid wearing makeup, lipstick, tanning products, or other skin products that may contaminate bathing areas.

• Please shower before entering any pools or bathing facilities available at the premises.

• Swimwear must be worn at all times. Nudity is not permitted.

• Muse Bathhouse is strictly an 18+ venue.

• Smoking, alcohol, and drugs are prohibited anywhere on the premises.

• Guests must follow all staff instructions and posted signage.

4. Health and Medical Disclosure

• You must disclose to staff before entry if you suffer from any health condition, including but not limited to: fever, diarrhoea, hypertension, cancerous conditions, risk of haemorrhaging, anaemia, heart disease, stroke, pregnancy, or diabetes.

• We may require you to sign a waiver acknowledging that you have been informed of the risks of entry.

• If you are unsure whether our facilities are safe for you, please seek medical advice prior to booking.

• We may refuse entry if we reasonably believe your condition may pose a risk to yourself or others (e.g., contagious conditions).

5. Bookings, Cancellations, and Refunds

• All bookings are subject to availability and must be paid in full at the time of booking.

• You may cancel or reschedule your booking by giving at least 24 hours’ notice prior to your session.

• Cancellations with less than 24 hours’ notice, or late arrivals of more than 15 minutes, will be charged in full and are non-refundable.

• Refunds will be made in accordance with your rights under the Australian Consumer Law (“ACL”). Nothing in these Terms limits or excludes those rights.

6. Lost Property

• We are not responsible for loss, theft, or damage to personal belongings.

• Unclaimed lost property will be held for 1 month, after which it may be donated to charity.

7. Risk and Liability

• You acknowledge the inherent risks associated with communal bathing and spa facilities.

• You agree to use our facilities and services at your own risk.

• To the extent permitted by law, Muse Bathhouse limits its liability for any breach of guarantees under the ACL to:

  • Re-supplying the services; or

  • Paying the cost of having the services re-supplied.

• Nothing in these Terms excludes or modifies your non-excludable rights under the ACL.

8. Refusal of Entry

We may refuse entry or require you to leave the premises immediately if:

• You are under the influence of alcohol or drugs;

• You behave in an abusive, harassing, unsafe, or sexually inappropriate manner towards guests or staff;

• You have a medical condition that poses a risk to others;

• You fail to comply with these Terms.

9. Gift Vouchers

9.1 Paid Gift Vouchers

• Gift vouchers purchased for money are valid for 1 years from the date of purchase, unless otherwise required by law.

• Vouchers are non-refundable and cannot be exchanged for cash.

• It is the responsibility of the holder to redeem the voucher before expiry.

9.2 Promotional / Complimentary Vouchers

From time to time, Muse Bathhouse may issue promotional, complimentary, or goodwill vouchers (“Promotional Vouchers”) that are provided free of charge and without payment or consideration by the recipient.

Promotional Vouchers:

• Are valid for 12 months from the date of issue, unless otherwise stated.

• Are not transferable, refundable, or redeemable for cash.

• May only be used for the goods or services stated on the voucher.

• Are subject to booking availability and all other Terms & Conditions.

These shorter expiry terms are permitted under the Australian Consumer Law because Promotional Vouchers are issued for no monetary consideration.

10. Privacy

• We collect personal and health information to provide our services and for safety purposes.

• By booking or entering the premises, you consent to the collection, use, and storage of your information in accordance with our Privacy Policy.

• Our Privacy Policy is available on our website and upon request.

11. Force Majeure

• We are not liable for any failure or delay in providing services due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, power outages, or public health emergencies.

• If such an event occurs, we may reschedule your booking or provide a credit in our discretion.

12. Changes to Terms

We may update these Terms & Conditions from time to time. The updated version will apply to all bookings made after the date of publication.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia.
Any disputes will be subject to the exclusive jurisdiction of the Queensland courts.
